FROG GRIPS PTY LTD – TERMS AND CONDITIONS (EU STORE)

Our Disclosures

Our complete Terms are set out below, but some important points for you to know are:

  • We may cancel an order before dispatch where reasonably necessary (e.g. stock issues, pricing errors). If we do, you will receive a full refund using your original payment method.

  • Our liability is limited as set out below, however nothing in these Terms excludes or limits your rights under applicable consumer law in the European Union.

DISCLAIMER

Our products include hand grips intended for athletic and gymnastic training purposes only.

You are responsible for determining whether our products are suitable for your intended use. Activities involving speed, motion or height carry a risk of injury.

You should:

  • Use products only as intended

  • Inspect products before each use

  • Seek guidance from a qualified professional if unsure

Nothing in this disclaimer limits your statutory rights.

1. Introduction

(a) This website is operated by FROG GRIPS PTY LTD (we, us, our).
(b) These Terms apply to all purchases made via our EU store.

2. Use of the Site

(a) By placing an order, you accept these Terms.
(b) You must be at least 18 years old or have permission from a legal guardian.
(c) You must not misuse the Site (e.g. unlawful use, interference, data scraping, etc.).

3. Accounts

You are responsible for:

  • Providing accurate information

  • Maintaining account confidentiality

  • All activity under your account

We handle personal data in accordance with our Privacy Policy and applicable EU data protection laws (including General Data Protection Regulation).

4. Orders

(a) Placing an order is an offer to purchase.
(b) We may accept or reject orders (e.g. stock unavailable, pricing errors).
(c) Once accepted, a binding contract is formed.
(d) You must check order details before submitting.
(e) Availability is not guaranteed.
(f) Pre-order dates are estimates only.
(g) Order Cancellation
We may cancel an order before dispatch where reasonably necessary. This does not affect your statutory rights.

5. Price and Payment

(a) Prices are shown in EUR (€) and include VAT where applicable.
(b) Payment must be made at checkout.
(c) We may offer third-party payment providers (e.g. Buy Now Pay Later), subject to their terms.
(d) We do not store payment details.
(e) Customs & Taxes

  • If shipping within the EU: no additional duties apply

  • If shipping from outside the EU: taxes/duties will be shown at checkout where applicable

6. Delivery, Title and Risk

(a) We deliver to EU locations listed on our Site.
(b) Delivery timeframes are estimates only.
(c) Risk & Ownership

  • Ownership transfers once full payment is received

  • Risk transfers to you when you (or your nominated person) receive the goods

7. Consumer Rights (EU)

If you are a consumer in the EU, you have legal rights under applicable consumer laws, including:

  • Consumer Rights Directive

  • Sale of Goods Directive

These include:

  • A 14-day withdrawal (cooling-off) period

  • Rights to remedies if goods are faulty, not as described, or not fit for purpose

Nothing in these Terms limits those rights.

8. Faulty or Non-Conforming Goods

If your product is:

  • Faulty

  • Not as described

  • Not fit for purpose

You are entitled to:

  • Repair or replacement

  • Refund (where repair/replacement is not possible or fails)

We will cover return shipping costs for faulty goods.

9. Warranty (Commercial)

We offer a 6-month commercial warranty covering manufacturing defects such as:

  • Structural damage

  • Delamination

  • Stitching faults

This warranty:

  • Does not cover normal wear and tear

  • Is in addition to your legal rights (which may extend longer under EU law)

10. Returns & Withdrawal

Your rights to returns (including change of mind within 14 days) are set out in our Refund & Exchange Policy, which forms part of these Terms.

11. Limitations of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect or consequential loss

  • Our liability is limited to the value of the products purchased

However:

We do not exclude or limit liability where it would be unlawful, including for:

  • Death or personal injury caused by negligence

  • Fraud

  • Breach of your statutory consumer rights

12. Intellectual Property

You may not copy, reproduce, or use our content commercially without permission.

13. General

(a) Disputes
We encourage resolving disputes informally first.

(b) Notices
 Email communication is acceptable.

(c) Privacy
 We comply with EU data protection laws (GDPR).

(d) Force Majeure
 We are not liable for delays outside our control.

(e) Amendments
 We may update these Terms; the version at purchase applies.

14. Governing Law

These Terms are governed by the laws of the country in which you are resident within the European Union.

You may bring proceedings in your local courts.
